On May 30 CNN reported that Schwartz, a veteran New York attorney, used cases provided by ChatGPT, an AI chatbot, in court documents filed, but many of the cases it cited were fabricated and fabricated. Schwartz has admitted that he failed to verify the information and apologized for it, and he faces sanctions.

Schwartz, the lawyer involved, has reportedly been practicing in New York for 30 years. He is representing a client, Mata, who is suing Columbia Airways over a knee injury he suffered when he was hit by a trolley while on a flight in August 2019, but the airline asked the Manhattan federal court to dismiss the case on the grounds that the statute of limitations had expired.

Schwartz cited six successful cases with similar rulings in his filings with the court, however, lawyers for Columbia Airways sent a letter to the judge in April questioning the authenticity of the information in the cases submitted by Schwartz. Judge Kevin Casteel of the Southern District of New York wrote in a written filing in early May that the verdicts, quotes and other citations in six of the cases were false.

Schwartz also admitted in a May 24 affidavit that he had used ChatGPT to collect cases. He asked ChatGPT about the authenticity of the cases, and ChatGPT repeatedly confirmed that the cases were authentic and available in a "trusted legal database.

Schwartz said he had never used ChatGPT as a legal research source before this case and therefore "did not know that its content could be false.

Schwartz said he regretted using artificial intelligence to supplement legal research and would never do so in the future without verifying the authenticity of its content.

Judge Custer, for his part, called the situation "unprecedented" and ordered a hearing on June 8 to punish Schwartz.
